Ratio Decidendi

The court held that the declaration of the Contempt of Court Act No.46 of 2016 as unconstitutional did not render the contempt proceedings commenced under it null and void. The legal position reverted to section 5 of the Judicature Act, which was deemed never to have been repealed, as the purported repeal by an unconstitutional Act was void ab initio. The court retains jurisdiction to entertain and determine contempt proceedings, and there is no requirement to recommence the application afresh. The preliminary objection by the respondents, premised on lack of jurisdiction and nullity of the proceedings, was found to have no merit and was dismissed with costs to the applicants.
