Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the defendants unlawfully attached the plaintiff's goods after the loan default.
  2. 2 Whether the plaintiff proved his case on a balance of probabilities.

Ratio Decidendi

The court found that while it was undisputed that the appellant's wife had defaulted on a loan and that the appellant was a guarantor, the appellant failed to prove that the respondents were responsible for the attachment of his goods. The only direct witness to the attachment did not identify the respondents as the persons who took the goods, nor did he specify which women's group received them. The trial court's finding that the appellant did not prove his case on a balance of probabilities was upheld. The appeal was dismissed as the appellant did not discharge the burden of proof required to establish the respondents' liability for the alleged unlawful attachment.
