Ratio Decidendi

The court found that the claimant was not unfairly terminated as he agreed to the termination subject to payment of terminal dues. The claim for gratuity was denied because the claimant was a member of NSSF and did not establish a contractual basis for gratuity. The court awarded the claimant Kshs. 100,000 in lieu of 22 leave days and Kshs. 90,000 for 27 days worked in January 2017, as admitted by the respondent. The claimant was also entitled to one month’s pay in lieu of notice. The respondent was ordered to pay the total sum of Kshs. 190,000 by 15.12.2018, failing which interest would accrue from the date of separation. Costs of the suit were also awarded to the claimant.
