Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the appellant was properly found in contempt of court orders without evidence of service or knowledge of the orders.
  2. 2 Whether the appellant, not being a party or agent in the original suit, could be held liable for contempt.
  3. 3 Whether the appellant was denied the right to be heard before being sentenced for contempt.

Ratio Decidendi

The court determined that the disputed factual issues—such as whether the appellant was properly served with the court order, whether he was an agent or party to the original suit, and whether he was aware of the order—cannot be resolved at the interlocutory stage. The court emphasized that it should not make final determinations on contested facts before the substantive appeal is heard. In the interests of justice, and to prevent the appeal from being rendered nugatory, the court granted a stay of execution of the contempt order, conditional upon the appellant depositing Kshs. 15,000 as security within 14 days. Costs were ordered to be in the cause.

Court Disposition

Stay of execution granted pending appeal, subject to deposit of security.
