Ratio Decidendi

The court found that the Respondent failed to provide evidence of any effort to contact the Claimant regarding alleged desertion. The mere assertion of desertion, without proof of steps taken to notify the employee or consider dismissal on that ground, is insufficient. Consequently, the court concluded that the Claimant's employment was terminated without valid cause and in violation of the procedural fairness requirements under the Employment Act, 2007. The Claimant was therefore entitled to compensation for unfair termination and payment in lieu of notice, but not to salary for October 2012 (already paid) or severance pay (no redundancy).

Orders

  • The Respondent shall pay the Claimant six months' salary in compensation (Kshs. 57,000).
