The court held that while the objector should have withdrawn the objection and answer to petition and cross application after being advised to file a summons for revocation or annulment of grant, the mere fact that both applications were made by the same party does not in itself dispose of either application. The preliminary objection raised was not a pure point of law capable of disposing of the matter and therefore could not be sustained. The preliminary objection was accordingly overruled and dismissed with costs.
