The High Court found that while the trial magistrate erred in awarding certain special damages that were not strictly proved and failed to properly offset awards under the Law Reform Act and Fatal Accidents Act, the multiplier of 30 years and dependency ratio of 2/3 were reasonable given the deceased's age and family circumstances. The court set aside the special damages award and substituted it with the amount strictly proved. The court also recalculated the total award, properly offsetting the relevant amounts and applying the agreed contributory negligence. The net award was adjusted accordingly.
