Ratio Decidendi

The court found that there was no longer any dispute between the parties regarding the distribution of the deceased's estate, as both the petitioner and the protestor, along with the other beneficiaries, had agreed to the protestor's proposed mode of distribution. The court noted that the proposal was consistent with the interests of all beneficiaries and was a departure from the petitioner's initial position. In light of the consensus, the court allowed the protest, confirmed the grant, and ordered that the estate be distributed in accordance with the protestor's proposal as set out in the affidavit of protest sworn on 17th February, 2014. Each party was ordered to bear their own costs.
