Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's termination was unfair and unlawful under the Employment Act.
  2. 2 Whether the claimant was accorded due process prior to termination.
  3. 3 What remedies, if any, the claimant is entitled to for the alleged unfair dismissal.

Ratio Decidendi

The court found that the claimant was terminated without being accorded a hearing or provided with reasons for his dismissal, in violation of sections 41, 43, 45, and 47 of the Employment Act. The respondent failed to appear or provide any evidence to justify the termination. The court held that the dismissal was both unfair and unlawful. However, the claimant was not entitled to all the remedies sought, as he failed to provide evidence for certain claims such as unpaid leave, non-remitted statutory deductions, or salary up to retirement. The court awarded the claimant one month's salary in lieu of notice and four months' salary as compensation for unfair dismissal, plus costs and interest.

Court Disposition

Claim partly allowed. Judgment for the claimant for notice pay, compensation, costs, and interest. Other claims dismissed.

Orders

  • The respondent shall pay the claimant one month's salary in lieu of notice (Kshs. 80,190).
  • The respondent shall pay the claimant four months' salary as compensation (Kshs. 320,760).
