Ratio Decidendi

The Tribunal found that the applicable interest rate for the Claimant's development loan was expressly stated as 1% per month in the loan application form executed by the Claimant. There was no evidence that the Claimant was informed of or consented to any variation of the interest rate to 1.5% per month as per the Respondent's circular. The Respondent's justification for applying the higher rate was unsubstantiated, as the contractual obligations were crystallized upon execution of the loan application form. Therefore, the deductions made by the Respondent based on the higher interest rate were unlawful, and the Claimant was entitled to recover the sum deducted, plus interest and costs.
