Procedural Posture

Civil Appeal / Ruling on Stay of Execution Pending Appeal

  1. 1 Whether the applicant has satisfied the legal grounds for grant of stay of execution pending appeal.
  2. 2 Whether substantial loss would result to the applicant if stay is not granted.
  3. 3 Whether the application was made without unreasonable delay.

Ratio Decidendi

The court found that the applicant demonstrated apprehension of substantial loss if evicted from her matrimonial home, as the respondent had threatened eviction and the subject matter of the appeal is the marriage contract. The court held that the purpose of stay is to preserve the subject matter so that the right of appeal is not prejudiced or rendered nugatory. Although there was some delay in filing the application, it was not inordinate. The court exercised its discretion not to impose security for costs, considering the circumstances and interests of justice. The application for stay of execution pending appeal was therefore meritorious and allowed.

Court Disposition

Application for stay of execution pending appeal allowed.
