Ratio Decidendi

The court found that it lacked jurisdiction to consolidate succession matters with other civil suits, as succession issues are to be handled by the designated succession court. The previous order consolidating the applications was therefore issued per incuriam and was vacated. The court directed that all related suits involving the subject land parcel, which are pending in the Environment and Land Court (ELC), be heard by Hon. Justice Gikonyo, J, or deferred until succession issues are resolved.
