Although the plaintiff was later offered the property after the purported cancellation of the 1st defendant's offer, he failed to comply with the conditions of his own letter of offer before the title deed was issued. The plaintiff did not execute a charge or discharge in respect of the property prior to the issuance of the title to the 1st defendant. The court held that the plaintiff's rights had not crystallised at the time the title was issued. Furthermore, the plaintiff neither pleaded nor proved fraud or mistake as required by law to impeach the 1st defendant's title....
