As such, she was incapable of complying with the principles set out in Giella v Cassman Brown & Co. Ltd for the grant of a temporary injunction. The court further noted that the surveyor's report, prepared pursuant to a consent order, had been filed but not availed to the parties, and ordered its release to enable the parties to consider its recommendations.
