Ratio Decidendi

The trial was a nullity because it was partly prosecuted by a Senior Sergeant, who was not qualified to act as a public prosecutor under Section 85(2) of the Criminal Procedure Code. The defect in prosecution rendered the entire trial invalid, regardless of whether part of the evidence was led by a qualified prosecutor. Furthermore, the court declined to order a retrial because the offences occurred six years prior, the evidence was insufficient to sustain a conviction, and the error was attributable to the prosecution. The conviction and sentence were therefore quashed, and any fines imposed were to be refunded to the appellant.
