Ratio Decidendi

The court found that the applicant, as the registered proprietor of the suit land, had established a prima facie case for the grant of a temporary injunction under Section 26(1) of the Land Registration Act. However, the respondent's unchallenged deposition that he has been in possession of the land for years and has developments on it warranted preservation of the status quo regarding those developments. The court therefore granted the injunction restraining the respondent from interfering with the suit land, but ordered that the respondent's developments remain intact pending the hearing and determination of the suit and counterclaim. Costs were ordered to be in the cause.
