The court reviewed comparable cases and determined that for the injuries suffered—bilateral tibia fibula compound fractures, right hip dislocation, chest pain, and multiple bruises and cut wounds—a fair award for general damages should be Kshs. 850,000/=. The court also held that the award for loss of school time was not justified as a separate head and should have been considered under general damages.
