Ratio Decidendi

The Tribunal found that the Claimant's term as a delegate had expired and that he was not eligible to contest in the subsequent elections due to loan default. The Claimant failed to rebut the Respondent's evidence regarding the expiry of his term and the holding of fresh elections. The Tribunal held that there were no special circumstances to warrant the grant of a mandatory injunction to compel the Respondent to withdraw its letter to the Claimant's employer. Similarly, the Tribunal found no basis to order reinstatement, as the Claimant's term had ended and there was insufficient material to support such an order. The application was therefore dismissed for lack of merit.
