The court found that the 3rd garnishee, having been duly served with the application and the garnishee order nisi, failed to file any opposition or attend court as required. Pursuant to Order 23 Rule 4 of the Civil Procedure Rules, the court is empowered to order execution against a garnishee who fails to dispute liability or attend court. The court therefore ordered that all sums held by the 3rd garnishee to the credit of the judgment debtor in the specified account be attached to satisfy the decree-holder's decrees in Misc.
