The High Court found that the trial court correctly determined it lacked territorial jurisdiction because the respondent resided in Kiambu and worked in Nairobi, and thus the suit should have been instituted in those jurisdictions. However, the trial magistrate erred in purporting to transfer the suit to Kiambu, as subordinate courts lack the power to transfer suits to other subordinate courts or to the High Court. The proper procedure would have been for the trial court to make a finding of lack of jurisdiction and leave it to the parties to move the High Court for transfer.
