The court held that Section 79G of the Civil Procedure Act grants discretion to admit an appeal out of time if good and sufficient cause is shown. The court was satisfied that the applicant had provided a plausible explanation for the delay and that justice would be served by granting leave to appeal out of time. The court therefore exercised its discretion in favour of the applicant, allowing the application for extension of time to file an appeal.
