The Court of Appeal found that the applicant had established an arguable appeal, particularly on whether the ELC properly interpreted and applied Order 42 of the Civil Procedure Rules in granting stay of execution without requiring security from the 1st respondent. The Court further held that, given the ongoing proceedings before the ELC, there was a real risk that the ELC appeal would be determined before the intended appeal could be heard, rendering the latter nugatory. The applicant thus satisfied both limbs required for the grant of stay under rule 5(2)(b): the existence of an arguable appeal and the risk of the appeal being rendered nugatory.
