Plot No. 56A at Tala was excluded from the estate as it had been validly transferred to the applicant and the widow as a gift inter vivos prior to the deceased's death, and the subsequent criminal charges of forgery against the applicant were dismissed for lack of evidence. The estate was to be distributed in accordance with section 40 of the Law of Succession Act, recognizing the polygamous nature of the family.
