The explanation for the delay, namely differences with former advocates, was not plausible for the entire period, especially after the new advocates came on record. The court held that the delay was inordinate and inexcusable, and that the plaintiff's prior concession to late filing of documents did not cure the lateness or entitle the defendants to particulars at this stage. Accordingly, the application for particulars was dismissed with costs to the plaintiff.
