The order nisi was duly served on both the garnishee and the respondent, neither of whom appeared to contest the application. The applicant's entitlement to the taxed costs was established by the Certificate of Taxation, which had not been set aside or altered. The court concluded that the funds held by the garnishee in account number 342556, belonging to the respondent, should be attached to satisfy the decree and the costs of the proceedings. The costs of the application were to be retained out of the recovered funds in priority to the amount due under the decree.
