The High Court found that while the prosecution proved the age of the complainant and the occurrence of sexual penetration, it failed to prove beyond reasonable doubt the identity of the appellant as the perpetrator. The DNA evidence was found unreliable due to gaps in the chain of custody and lack of testimony from the escorting officer. Additionally, the existence of a family dispute raised the possibility of a frame-up. The trial court should have given the benefit of the doubt to the appellant. Consequently, the conviction was quashed and the sentence set aside.
