Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside Judgment and Stay Execution

  1. 1 Whether the Notice of Motion dated 21st September 2021 was duly served on the Respondents or their advocates.
  2. 2 Whether the judgment entered on 11th November 2021 should be set aside for lack of service.

Ratio Decidendi

The court found that the Notice of Motion dated 21st September 2021 was duly served on the Respondents' advocates then on record, Michael Gitonga Advocates, as evidenced by affidavits of service and court records. The Respondents failed to provide a satisfactory explanation for their non-attendance or for their advocates' failure to act. The court held that service on the advocate on record is proper service, and the Respondents' subsequent change of advocates did not invalidate the prior proceedings. Consequently, there was no merit in the application to set aside the judgment or to stay execution, and the application was dismissed with costs.

Court Disposition

application dismissed with costs
