Ratio Decidendi

The court found that the petitioner had established, on a balance of probabilities, that the marriage had irretrievably broken down due to the respondent's cruelty and desertion. The evidence showed that the respondent verbally and physically assaulted the petitioner, neglected his duties as a husband and provider, and that reconciliation attempts had failed over a period of four years. The respondent, by his cross-petition, also conceded that the marriage could not be salvaged. The court therefore granted the petition for divorce and awarded custody of the children to the petitioner, finding this to be in their best interests.
