The court held that the applicant, having been convicted, no longer enjoys the presumption of innocence and is not entitled to bond as of right under Article 49 of the Constitution. Bond pending appeal is only granted in special or compelling circumstances, which the applicant failed to demonstrate. The court found no irregularity in the trial proceedings or any infringement of constitutional rights. The sentence of 25 years was not considered a basis for bond since the appeal would be concluded within a year, negating the argument that a substantial part of the sentence would be served before determination.
