Ratio Decidendi

The court found that under Kamba customary law, the respondent's marriage to another woman did not constitute adultery, as polygamy is permitted. The petitioner failed to provide sufficient evidence of adultery or cruelty, as required by law. However, the parties had been separated since 2009, and all efforts at reconciliation had failed. The court held that the prolonged separation was clear evidence that the marriage had irretrievably broken down. As such, the only viable ground for dissolution was irretrievable breakdown of the marriage, and the court granted the divorce on this basis.
