The court held that the principal, Lucy Rukanga, could not be sued in her personal capacity for decisions made by the Board of Management, as the Board is a legal entity with capacity to sue and be sued. There were no allegations against her in her personal capacity, and it would be improper to subject her to proceedings for Board decisions. The plea of res judicata failed because the consent order of 30th June 2015 only released the Kenya National Examinations Council and did not determine the entire petition.
