Ratio Decidendi

The court found that the petitioner had established, on a balance of probabilities, that the respondent deserted her from 8th March 1996 and had not communicated or cohabited with her for over seven years. The evidence showed the marriage had irretrievably broken down due to the respondent's desertion. The court was satisfied that the petition was not presented through collusion and that the petitioner had suffered mental anguish and anxiety as a result of the abandonment. Accordingly, the court granted a decree nisi for divorce, to be made absolute after three months, and awarded costs to the petitioner.

Court Disposition

petition allowed; decree nisi for divorce granted; costs awarded to petitioner

Orders

  • A decree nisi for divorce shall issue for a period of three months.
  • The petitioner is entitled to the costs of the petition.
