The court found that the appeal was incompetent because it challenged directions/orders of the Children’s Court Magistrate that do not fall within the category of orders appealable as of right under section 75 of the Civil Procedure Act. No certified copy of the ruling allegedly delivered on 6th August, 2024 was annexed, and the lower court file confirmed that no such ruling existed. The applicant failed to seek leave to appeal as required by law. Consequently, both the appeal and the application for stay of execution, which was premised on the appeal, were struck out for being improperly before the court.
