Ratio Decidendi

The court found that neither the claimant nor the respondent produced any terms and conditions of service that provided for suspension. Since the Employment Act does not itself provide for suspension and no contractual or regulatory basis for suspension was established, the court held that the claimant's suspension was unlawful. Consequently, the court ordered the immediate lifting of the suspension and the release of all salary withheld during and as a result of the unlawful suspension.
