Procedural Posture

Employment Cause / Judgment

  1. 1 Was there a valid reason for the termination of the Claimant's contract?.
  2. 2 Was the decision to terminate the Claimant's contract arrived at fairly?.
  3. 3 Is the Claimant entitled to the reliefs sought, including compensation, annual leave pay, notice pay, and certificate of service?.

Ratio Decidendi

The court found that the Respondent failed to provide valid and substantiated reasons for the Claimant's termination. The allegations of professional misconduct and fraudulent acts were generalized and unsupported by evidence. The warnings for absenteeism did not amount to gross misconduct given the Claimant's job description, which required him to be in the field. The Respondent's policy of forfeiting annual leave was contrary to statutory law, and the Claimant was entitled to accrued leave for the years 2011-2013. The Claimant was not eligible for service pay due to NSSF contributions. The Claimant admitted to having received a fair hearing, so procedural fairness was not in dispute....

Court Disposition

Claim partly allowed; termination declared unfair; compensation and terminal dues awarded.
