Ratio Decidendi

The court found that the claimant was terminated without being given the two warnings required by his contract and without being subjected to any disciplinary hearing, as admitted by the respondent's witness. The reasons for termination were not adequately explained, and the respondent failed to follow the laid down procedure under Section 45(2) of the Employment Act, 2007. Consequently, the termination was deemed unfair and unjustified. The court awarded the claimant one month salary in lieu of notice, six months salary for the remainder of the contract period, three months salary as damages for unfair termination, a certificate of service, and costs of the suit with interest.
