The court found that the petitioner was unlawfully detained for 38 days beyond his lawful sentence due to an error in the committal warrant issued by the court. While the detention was inadvertent and not a result of deliberate action by the prison authorities, the responsibility for the error lay with the court officers who issued the incorrect warrant. The petitioner, however, also failed to mitigate the situation by not raising the anomaly at the earliest opportunity, despite being informed of his sentence and issued a labour card.
