Ratio Decidendi

The court found that the Plaintiffs, specifically the 5th Plaintiff, had been in exclusive and continuous occupation of the suit land (Suna East/Wasweta 1/13103) since about 1990. Although the Plaintiffs believed their occupation was as purchasers, the court determined that their occupation became adverse to the registered proprietor when the title was transferred to the 2nd Defendant on 6th December 1995. The Plaintiffs' occupation was not interrupted, and the Defendants did not take possession even after registration. By the time the suit was filed in August 2011, the Plaintiffs had been in adverse possession for approximately sixteen years, exceeding the statutory twelve-year period....
