Ratio Decidendi

The court found that the applicant, supported by her son, provided credible and unchallenged evidence that B B O disappeared on 24/06/2006 and has not been seen or heard from since, despite diligent efforts by family, friends, and the police. The applicant and her son are persons who would be expected to have heard from B B O if he were alive. No evidence was presented to rebut the presumption of death. The requirements of Section 118A of the Evidence Act were therefore satisfied, and the court granted the order presuming B B O dead.
