Jobic v Indepth Research Institute (Commercial Case E385 of 2026) [2026] SCC 150 (KLR) (25 June 2026) (Judgment) Neutral citation: [2026] SCC 150 (KLR) Republic of Kenya In the Small Claims Court at Mombasa Commercial Case E385 of 2026 TN Mwangeka, RM June 25, 2026 Between Riziki Jobic Claimant and Indepth Research Institute Respondent Judgment 1.The Claimant states that on 14th October, 2024 and 30th January 2026, the Respondent engaged him vide several contracts to provide training services for their clients for an agreed amount for each of the training sessions. For the said period, Claimant's total payment amounted to Kshs. 348, 000/- out of which he received Kshs. 194, 720/- only leaving an unpaid balance of Kshs. 153, 280/-. It was a term of contracts that payments be made immediately each training exercise is over. The Claimant delivered on his part of the bargain. The Respondent however, despite numerous demands and calls upon him to settle the debt, has refused and or failed so to pay necessitating the filing of this claim. 2.When the matter came up for hearing on 17th June 2026, the Claimant stated that after filling the instant claim, the Respondent had made part payments amounting to Kshs. 111,880/-. The current balance therefore stands at Kshs. 41,400/-. In support of the claim, the Claimant has filed various documentation in support which this court has perused and finds them to sufficiently prove the claim. 3.The Respondent despite service, has never entered appearance nor filed a defence. Consequently, the court having looked at the Statement of Claim and the lodged documents in support of the Claim; satisfied that there was proper service upon the Respondent, and in the absence of entering of an appearance by the Respondent or filing of any Response, the Court hereby enters judgment in favour of the Claimant against the Respondent for a sum of Kshs. 41,400/- being the balance of the principal sum of Kshs. 153,280/-.
