The court found that the applicant had established that the respondent was served with the bill of costs and notice of taxation, the bill was taxed at Kshs. 158,922, and a certificate of taxation was issued on 7th August 2023. The respondent did not challenge, set aside, or appeal the certificate, nor was there any dispute as to retainer. Section 51(2) of the Advocates Act makes such a certificate final as to the amount of costs, and the court is empowered to enter judgment for the certified sum. Regarding interest, the court held that Rule 7 of the Advocates Remuneration Order entitles the advocate to interest at 14% per annum from one month after service of the bill, which in this case...
