Ratio Decidendi

The court found that the appeal was fatally incompetent as it was filed outside the prescribed time without leave of court. The appellant did not dispute this fact and had not sought leave to regularize the appeal. Furthermore, the appellant failed to prosecute the appeal within the six-month period as ordered when the stay of execution was granted. Since there was no valid appeal before the court and no stay of execution in force, the court saw no reason to withhold the release of the funds deposited as a condition for stay. The court therefore struck out the appeal, ordered the release of the deposited funds to the respondent, and awarded costs to the respondent.
