The court found that the Kipipiri Land Disputes Tribunal acted in excess of its jurisdiction by making an award affecting title to land registered under the Registered Land Act, which was outside the scope of its statutory powers under Section 3 of the Land Disputes Tribunal Act. As a result, the tribunal's decision was ultra vires, null, and void. The magistrate's court, though statutorily required to adopt tribunal awards, could not validate a void decision. The applicant was also denied the right to be heard before the tribunal.
