Ratio Decidendi

The trial magistrate erred by ordering the sentences to run consecutively for offences that arose from the same criminal transaction. The law, as stated in Section 14(1) of the Criminal Procedure Code and affirmed in relevant case law, requires that sentences for offences committed in the same transaction be ordered to run concurrently. The appellate court found that the trial court acted on wrong principles in sentencing, warranting interference. The sentences were therefore corrected to run concurrently from the date of the original sentence.
