Ratio Decidendi

The High Court, sitting as a probate and succession court, lacks jurisdiction to grant injunctions in succession matters or to order rectification of entries in the land register. Section 45 of the Law of Succession Act criminalizes intermeddling but does not empower the court to issue injunctions. Rule 73 of the Probate and Administration Rules cannot be invoked to grant orders not contemplated by the Law of Succession Act, and Order 40 of the Civil Procedure Rules (which provides for injunctions) is not imported into probate practice. Rectification of the land register falls exclusively within the mandate of the Environment and Land Court under Section 8 of the Land Registration Act....
