Procedural Posture

Miscellaneous Application / Ruling on Application for Joinder and Interim Orders

  1. 1 Whether Paul Gicheru should be enjoined as a defendant in the suit.
  2. 2 Whether the Land Registrar should be restrained from dealing with the suit property pending determination of the suit.
  3. 3 Whether status quo should be maintained on the suit property.

Ratio Decidendi

The court found that Paul Gicheru, being the registered proprietor of the suit property, is a necessary party to the proceedings as any decision made would likely affect his interests. The court held that it is just, fair, and prudent to enjoin him as a defendant to enable the court to effectually and completely adjudicate upon and settle all questions involved in the suit. The court further found it appropriate to restrain the Land Registrar from dealing with the suit property and to maintain the status quo pending the hearing and determination of the suit, to preserve the subject matter and prevent prejudice to any party.

Court Disposition

Application allowed in part; Paul Gicheru enjoined as defendant; interim orders granted.

Orders

  • Paul Gicheru is enjoined as the 6th defendant in the suit.
  • The originating summons to be amended to include Paul Gicheru and state the claim against him.
