The court found that although the applicants did not seek stay immediately after judgment or before the trial court, the need to secure the suit lands from disposition pending appeal is paramount to prevent complications should the appeal succeed. The court noted that both parties failed to provide documentary evidence of current land registration, but accepted the applicants' apprehension as reasonable. The court held that, irrespective of whose names the properties are currently registered in, an inhibition order is necessary to preserve the subject matter of the appeal. The court therefore exercised its discretion to issue an inhibition order under Section 68 of the Land Registration...
