Ratio Decidendi

The court held that the preliminary objection raised by the 3rd respondent did not meet the threshold of a pure point of law as established in Mukisa Biscuit and subsequent authorities. All the grounds raised required proof by way of evidence and referred to documents outside the pleadings. The court further found that the preliminary objection was being used as a sword rather than a shield, contrary to the principles set out by the Supreme Court. Since the grounds were not limited to the pleadings and required factual determination, the preliminary objection could not be sustained. Accordingly, the preliminary objection was dismissed.
