Although the suit had abated due to the failure to substitute the Plaintiff within one year of his death, the Applicant had provided a reasonable explanation for the delay, namely that no legal representative had been appointed until he obtained a grant of letters of administration. The court held that the Applicant, now the legal representative, was entitled to seek revival of the suit and substitution as Plaintiff. The application was therefore meritorious and allowed in terms of revival and substitution, with costs in the cause.
