Ratio Decidendi

The court held that the claim was statute barred under Section 90 of the Employment Act, as the cause of action for unlawful termination accrued on the date of dismissal, 1st April 2009. The filing of an appeal against dismissal did not stop the limitation period from running. Since the claim was filed on 21st March 2016, well beyond the three-year limitation period, the court lacked jurisdiction to entertain the matter. Consequently, the claim was struck out without consideration of the substantive issues raised.
